General Terms and Conditions for the Online Shop of Strider Europe BV
- Scope of application / contact details
- These general terms and conditions (hereinafter referred to as “GTC”) shall apply to all contracts concluded between us, Strider Europe B.V., Willem Dreesweg 2, 1st Fl. South Wing, 1185 VB Amstelveen, The Netherlands, and you as our customer via our online shop on [link].
- Any divergent, contradictory or supplementary general terms and conditions shall become part of the contract only if we have expressly accepted them in writing. Our mere knowledge of your general terms and conditions shall not make them part of the contract.
- The version of the GTC valid at the time of the conclusion of your contract with us shall apply. By placing your order with us, you accept the then-current version of the GTC.

- Delivery destinations
We only accept orders for delivery to the following countries: France, Germany, Italy, Spain, The Netherlands and The United Kingdom.
- Conclusion of contract and information on contract conclusion
- The presentation and promotion of goods in our online shop does not constitute a binding offer for the sale of certain goods.
- After selecting the button “View Cart” or clicking the cart icon, all the goods you selected to buy will be displayed including a description of their main characteristics. You may then identify and correct any input errors. By subsequently selecting the button “Order with Obligation to Pay”, you submit a legally binding offer to buy the selected goods.
- Your order does not yet constitute the conclusion of a contract. We will confirm receipt of your order by e-mail; however, this confirmation does not constitute a legally binding acceptance of your order. We reserve the right not to accept your order, in particular, if the goods you ordered are limitedly or not available.
- A contract for the goods you ordered will be concluded (i) once we have provided you with an invoice or (ii) implied by our performance of the delivery of the goods you ordered. You will receive a confirmation of the contract concluded at the latest at the time of the delivery of the goods.
- Prices and shipping costs
- The purchase prices of the goods are determined by the price tags displayed in the online shop at the time of the order. Unless indicated otherwise, all prices in our online shop are gross prices including the applicable VAT.
- Shipping costs may apply. To the extent shipping costs apply, they will be added to the displayed purchase prices and must be borne by you. The total purchase price including VAT and shipping costs (which will also be displayed separately) will be shown on the order form before you submit the order.
- If we fulfill your order by partial delivery, we will charge shipping costs only for the first partial delivery. If the partial delivery takes place at your express wish, we will charge shipping costs for every partial delivery.
- Payment and offsetting
- The purchase price will be due immediately upon conclusion of the contract. You will be charged at the time we accept your order.
- You may not offset counterclaims against our claims, unless your counterclaims are finally adjudicated, ready for decision or uncontested.
- The goods will remain our property until we have received complete payment of the purchase price.
- Delivery/partial deliveries
- Delivery periods and delivery deadlines will be provided in the course of the ordering process.
- We are entitled to make partial deliveries, if this is reasonable for you.
- The goods will be shipped by local carriers. You will receive information about the specific carrier shipping to you as well as a tracking number so you can track the shipment.
- In the absence of any express instruction by you, shipment will be made using a reasonable method of shipment in the usual manner of packaging.
- Right of withdrawal
- If you are a consumer and have purchased in the online shop one good or several goods that are delivered in one delivery, the instruction on the right of withdrawal set out in Attachment 1 to these GTC applies.
- If you are a consumer and have purchased in the online shop several goods that are delivered in partial deliveries, the instruction on the right of withdrawal set out in Attachment 2 to these GTC applies.
- To make use of your right of withdrawal you may use the model withdrawal form set out in the Attachment 3 to these GTC. Please note that it is not obligatory to use this form.
- Defects of quality and title
In the event of any defects of quality or title, you are entitled to all rights pursuant to the relevant provisions of statutory law.
- Liability
- Our liability for damages caused by slight negligence, irrespective of its legal ground, shall be limited as follows:
- We shall be liable up to the amount of the foreseeable damages typical for this type of contract for a breach of material contractual obligations;
- We shall not be liable for a slightly negligent breach of any other duty of care applicable.
- These limitations of liability shall not apply to any mandatory statutory liability, in particular to liability under any laws relating to product liability, and liability for culpably caused injuries of life, body or health. In addition, such limitations of liability shall not apply if and to the extent we have assumed a specific guarantee.
- Sections 1 and 9.2 shall apply accordingly to our liability for futile expenses.

- Applicable law and venue
The GTC and any contract shall be governed by Dutch law with the exception of the United Nations Convention on Contracts for the International Sale of Goods. For all customers who are not consumers, the exclusive venue for any and all disputes arising from or in connection with the GTC and/or contract shall be Schiphol, The Netherlands.
- Alternative dispute resolution
We are neither ready nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Consumer information according to Regulation (EU) 524/2013: For the purpose of out-of-court settlement of consumer disputes, the European Commission has established an Online Dispute Resolution Platform (ODR Platform). The ODR Platform can be reached at http://ec.europa.eu/consumers/odr/.

Attachment 1: Instruction on the right of withdrawal for single deliveries
If you are a consumer and have purchased in the online shop one good or several goods that are delivered in one delivery, the following instruction on the right of withdrawal applies:
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (Strider Europe B.V., Dr. Willem Dreesweg 2, 1st Fl. South Wing, 1185 VB Amstelveen, The Netherlands; E-mail: europe@striderbikes.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or
e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. The cost is estimated at a maximum of approximately EUR 200 or GBP 190. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
